Terms of Service

Welcome to LiCoWa! These Terms of Service ("Terms") govern your use of the LiCoWa mobile application (the "App") provided by Shining Ai Inc. ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

Important: Please read these Terms carefully before using the App. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that:

• You are at least 14 years old, or have obtained parental/guardian consent
• You have the legal capacity to enter into a binding agreement
• You agree to comply with all applicable laws and regulations
• You have read and understood our Privacy Policy

2. Description of Services

LiCoWa provides the following services:

• Photo Booth: Create classic photo strips with various filters and countdown timers
• DIY Wallpaper: Design custom lock screen wallpapers using templates
• Photo Collage: Combine photos into beautiful collage layouts
• Wallpaper Library: Browse and download curated wallpaper designs

We reserve the right to modify, suspend, or discontinue any part of the services at any time without prior notice.

3. User Account

Some features of the App may require you to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if we suspect any violation of these Terms.

4. User Content

You retain ownership of any content (photos, images, designs) you create or upload using the App ("User Content"). By using the App, you grant us a non-exclusive, royalty-free license to:

• Process your User Content to provide the services
• Store your User Content on our servers as necessary for the App's functionality

You represent and warrant that:

• You own or have the necessary rights to the content you upload
• Your User Content does not infringe any third-party rights
• Your User Content does not contain illegal, harmful, or offensive material

5. Prohibited Conduct

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Upload content that is defamatory, obscene, pornographic, or harmful
• Infringe upon the intellectual property rights of others
• Attempt to reverse engineer, decompile, or hack the App
• Introduce viruses, malware, or other harmful code
• Interfere with or disrupt the App's servers or networks
• Use automated systems (bots, scrapers) to access the App
• Impersonate any person or entity
• Collect or harvest user data without consent

6. Intellectual Property

The App and its original content (excluding User Content), features, and functionality are owned by Shining Ai Inc. and are protected by international copyright, trademark, and other intellectual property laws.

Our trademarks, logos, and service marks may not be used without our prior written consent.

The templates, designs, and assets provided within the App are licensed for personal, non-commercial use only unless otherwise specified.

7. In-App Purchases and Subscriptions

The App may offer in-app purchases or subscription services. By making a purchase, you agree to:

• Pay all applicable fees and taxes
• The pricing and payment terms displayed at the time of purchase
• The subscription renewal terms (if applicable)

Refunds are subject to the policies of the respective app store (Apple App Store or Google Play Store) through which you made the purchase.

8. Third-Party Services

The App may contain links to or integrations with third-party services. We are not responsible for:

• The content, accuracy, or practices of third-party services
• Any damage or loss caused by your use of third-party services

Your use of third-party services is governed by their respective terms and privacy policies.

9. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any defects in the App will be corrected

10. Limitation of Liability

To the maximum extent permitted by law, Shining Ai Inc. shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, or goodwill
• Any damages resulting from unauthorized access to your account or data
• Any damages arising from your use or inability to use the App

11. Indemnification

You agree to indemnify and hold harmless Shining Ai Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the App or website. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

We encourage you to review these Terms periodically for updates.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including:

• Breach of these Terms
• Suspected fraudulent, abusive, or illegal activity
• Request by law enforcement or government agencies

Upon termination, your right to use the App will immediately cease.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved through:

1. Good faith negotiation between the parties
2. If negotiation fails, submission to a court with jurisdiction at the defendant's location

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
